1. Acceptance of Terms
Section titled “1. Acceptance of Terms”By accessing or using Islamic Open Finance™ platform services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.
2. Description of Services
Section titled “2. Description of Services”Islamic Open Finance™ provides a Shariah-native financial infrastructure platform including:
- Contract management and lifecycle services
- KYC/AML compliance services
- Treasury and clearing services
- Analytics and reporting capabilities
- API access for application integration
- Webhook event notifications
3. Eligibility
Section titled “3. Eligibility”You must be at least 18 years old and have the legal capacity to enter into contracts to use our Services. By using the Services, you represent and warrant that you meet these requirements.
4. Account Registration
Section titled “4. Account Registration”To access certain features, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
5. Acceptable Use
Section titled “5. Acceptable Use”You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or interfere with the Services
- Attempt unauthorized access to systems or data
- Use the Services for money laundering or terrorist financing
- Engage in any activity contrary to Islamic finance principles
6. API Usage
Section titled “6. API Usage”When using our APIs, you agree to:
- Comply with all API documentation and rate limits
- Maintain the confidentiality of API keys
- Not share API credentials with unauthorized parties
- Implement appropriate security measures in your applications
7. Shariah Compliance
Section titled “7. Shariah Compliance”Our Services are designed to facilitate Shariah-compliant financial transactions. Users acknowledge that:
- The platform operates according to Islamic finance principles
- Shariah Board oversight ensures compliance with Islamic law
- Users are responsible for ensuring their specific use cases comply with applicable Shariah requirements
8. Fees and Payment
Section titled “8. Fees and Payment”- Fees are as set forth in your service agreement
- All fees are exclusive of taxes unless stated otherwise
- Payment is due according to your billing cycle
- Failure to pay may result in service suspension
9. Intellectual Property
Section titled “9. Intellectual Property”Islamic Open Finance™ and its licensors retain all intellectual property rights in the Services. You receive only the rights expressly granted in these Terms.
10. Data Protection
Section titled “10. Data Protection”Our collection and use of personal data is governed by our Privacy Policy. By using the Services, you consent to such collection and use.
11. Confidentiality
Section titled “11. Confidentiality”Both parties agree to maintain the confidentiality of any confidential information disclosed during the use of Services.
12. Warranties and Disclaimers
Section titled “12. Warranties and Disclaimers”THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
Section titled “13. Limitation of Liability”TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISLAMIC OPEN FINANCE™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
14. Indemnification
Section titled “14. Indemnification”You agree to indemnify and hold harmless Islamic Open Finance™ from any claims arising from your use of the Services or violation of these Terms.
15. Termination
Section titled “15. Termination”We may terminate or suspend your access to the Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.
16. Governing Law
Section titled “16. Governing Law”These Terms shall be governed by and construed in accordance with the laws of the jurisdiction specified in your service agreement, without regard to conflict of law principles.
17. Dispute Resolution
Section titled “17. Dispute Resolution”Any disputes shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration authority, unless otherwise specified in your service agreement.
18. Changes to Terms
Section titled “18. Changes to Terms”We reserve the right to modify these Terms at any time. We will notify you of material changes through the Services or via email. Your continued use after such notification constitutes acceptance of the modified Terms.
